1. Welcome & Introduction
Thank you for choosing CodeBurst Pty Ltd as your software development and digital transformation partner. This document outlines the legal and procedural framework to guide our collaboration.
2. Onboarding Criteria
To begin your engagement with CodeBurst, the following criteria must be met:
• Completion of Client Information Form
• Submission of KYC Documents (Government-issued ID, Proof of Address)
• Project Scope Definition and Approval
• NDA (Non-Disclosure Agreement) Signed by Both Parties
• Initial Deposit or Payment Terms Agreement
• Technical Requirements Assessment (if applicable)
• Compliance Review for Fintech/Blockchain Clients
• Contact Person and Communication Preferences Specified
• Approval of CodeBurst’s Terms and Conditions and EULA
• Acknowledgment of Security and Data Access Protocols
• Agreement on Project Timeline, Support Plan, and Milestone Dates
• Confirmation of Compensation Terms (e.g., cash, services, access, references)
• Assignment of Technical Point of Contact (Client or Team Member)
• Review of Human Rights and Ethics Policy (required for NGO/edu clients)
3. Confidentiality & NDA
All clients and collaborators are required to sign a Non-Disclosure Agreement before any sensitive information is exchanged. This protects client data, IP, and confidential processes.
4. End User License Agreement (EULA)
The EULA governs how clients and their users may access and use the software provided by CodeBurst. Key terms include:
• Grant of License (non-transferable unless otherwise agreed)
• Restrictions on reverse engineering or redistribution
• Termination of use in case of breach
• Jurisdiction for legal disputes
5. Warranty & Disclaimer
CodeBurst warrants that software will perform substantially as described in specifications. However:
• Software is provided “as-is” without guarantees of uninterrupted functionality.
• We are not liable for loss due to misuse, third-party integrations, or external vulnerabilities.
• Bug fixes and enhancements are handled per contract.
6. Intellectual Property & Open Source Licenses
Custom-developed code is the property of CodeBurst until payment is complete, after which usage rights or ownership are granted per agreement.
Some solutions may include open-source components under licenses such as MIT, GPL, or Apache 2.0, which remain subject to their original licensing conditions.
7. Freelance & Subcontractor Agreements
Freelancers and subcontractors engaged by CodeBurst operate under strict NDAs and project-based contracts. CodeBurst ensures:
• All third-party personnel follow compliance, timelines, and quality standards
• Access control, work-for-hire clauses, and non-compete terms are enforced
• Compensation is flexible and may include internet access, use of tools, technical mentorship, and experience certification instead of monthly payments
• Reference letters can be issued to acknowledge contributions to specific projects
8. Network Protocols & Security 🔐
CodeBurst enforces best practices for network and system security, including:
• End-to-end encryption (HTTPS, TLS 1.2+)
• Role-based access and multi-factor authentication
• VPN-secured developer and admin access
• Secure API design, firewall configurations, and penetration testing

9. Terms & Conditions
This governs our working relationship, including service boundaries, liabilities, project changes, delays, termination procedures, and dispute resolution. Clients must acknowledge and agree before project kickoff.
10. Payment & Compensation Policy
• 40% deposit required upfront for fixed-price projects
• Remaining 60% is milestone-based or on delivery
• Where monthly payments are not feasible, compensation may include:
- Access to internet data and development tools
- Portfolio support and technical experience
- Public recommendation and verified references
• Invoices and formal records are maintained for all transactions
11. Financial Policy
CodeBurst operates under a transparent and accountable financial policy:
• All client funds are receipted and tracked
• No cash payments accepted without documentation
• External audits and tax compliance are part of annual reviews
• No hidden charges—quotes reflect full expected costs
12. Human Rights & Fair Work Policy
CodeBurst supports human rights, equality, and ethical labor practices. We ensure:
• No discrimination based on gender, race, religion, or disability

13. Attachment & File Policy
CodeBurst maintains strict attachment guidelines to protect both our clients and our systems:
• Attachments must be virus-scanned and relevant to the project
• File formats accepted: PDF, DOCX, XLSX, PNG, JPEG, MP4, ZIP
• Suspicious, harmful, or pirated content will be deleted without notice
